Pint Pinger Terms of Service

These terms are the agreement between you and the operator of Pint Pinger. By using the app you accept them. If you do not accept them, do not use the app.
1. What Pint Pinger is
Pint Pinger is a private photo log for small groups of friends who want to show each other what they are drinking. You join a group by invite code, post photos, and react to your friends' posts. There is no public feed, no follower graph, and no way for a stranger to see your content.
The app is operated by Sebastian Belfiore ("the operator", "we"), an individual, not a company. Contact: Seb@belfiore.io.
2. Who can use it
Pint Pinger is for people of legal drinking age in the country where they live. By using the app you confirm that you meet that age. The app asks you to confirm this before you can use it. If you do not, you cannot use the app.
3. Your account
Your account is your iCloud identity. There is no separate registration, username, or password held by us. You choose a display name, and you are responsible for everything posted under it.
You can delete your account, and everything you have posted, at any time from Settings inside the app. Deletion is permanent and cannot be undone.
4. Your content
You keep ownership of everything you post.
By posting, you give the other members of your groups the ability to view your content inside the app, and you give the operator the technical permission needed to store and transmit it (through Apple's iCloud service) so that the app can work. That permission exists only to run the app. We do not sell your content, license it to anyone, or use it to advertise.
You are responsible for having the right to post what you post.
5. Objectionable content and abusive users: zero tolerance
There is no tolerance for objectionable content or abusive behaviour in Pint Pinger. This includes, without limitation: harassment or bullying, hate speech or slurs, sexually explicit material, content depicting or promoting violence, illegal content, spam, and impersonation.
- Every post and every comment can be reported from within the app.
- Reported content is hidden immediately for the person who reported it.
- Reports are reviewed and acted on within 24 hours. Action may include removing the content and ejecting or banning the user who posted it.
- You can block any user from within the app. Blocking hides your content from each other, in both directions.
- Group founders can remove members from their groups at any time.
Posting objectionable content, or abusing other users, ends your access to the app.
6. Groups and invite codes
Anyone holding a group's invite code can join that group. Treat a code like a door key and share it only with people you actually want in the group. The founder of a group can remove members. A removed member loses access to that group but can be invited back with the code. If a founder deletes their account, the group passes to its longest-standing remaining member.
7. Sensible use
Pint Pinger is a log, not a challenge. It must not be used to pressure anyone into drinking, and it contains no targets, scores, or contests about how much anyone drinks. Nothing in the app is medical or health guidance. Please drink responsibly. A link to public drinking guidance is in the app's Settings.
8. Things you must not do
Do not use the app to break the law. Do not attempt to access other people's accounts or content, interfere with the service, scrape it, or reverse engineer it beyond what the law permits. Do not upload malware. Do not use the app to send anyone content they have told you they do not want to receive.
9. Availability and changes
The app is provided as it is, without warranty of any kind, to the extent the law allows. We may change, suspend, or discontinue the service, and we may update these terms. If the terms change materially, the app will ask you to accept the change before you continue using it.
You can stop using the app at any time by deleting your account.
10. Liability
To the extent the law allows, the operator is not liable for content posted by users, for anything that happens as a result of drinking, or for indirect or consequential loss. Nothing in these terms limits liability that cannot lawfully be limited, including liability for death or personal injury caused by negligence, or for fraud.
If you are a consumer, you keep all the statutory rights your local law gives you, and nothing here removes them.
11. Apple
You and the operator acknowledge the following, which Apple requires of apps distributed through the App Store:
- This agreement is between you and the operator only, not with Apple. The operator, not Apple, is solely responsible for the app and its content.
- Your licence to use the app is a non-transferable licence to use it on any Apple-branded product that you own or control, as permitted by the Usage Rules in the App Store Terms of Service.
- Apple has no obligation to provide any maintenance or support for the app. Support is provided by the operator, at Seb@belfiore.io.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app, if any. To the maximum extent permitted by law, Apple has no other warranty obligation of any kind with respect to the app.
- The operator, not Apple, is responsible for addressing any claim by you or a third party relating to the app, including product liability claims, claims that the app fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
- The operator, not Apple, is responsible for the investigation, defence, settlement, and discharge of any third-party claim that the app infringes that third party's intellectual property rights.
- You represent that you are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any US Government list of prohibited or restricted parties.
- You must comply with any applicable third-party terms of agreement when using the app.
- Apple and its subsidiaries are third-party beneficiaries of these terms, and upon your acceptance, Apple has the right (and is deemed to have accepted the right) to enforce these terms against you as a third-party beneficiary of them.
12. Governing law
Pint Pinger is a free app run by one person, and these terms do not try to drag anyone into a foreign court. If you are a consumer, the mandatory consumer protection laws of the country where you live apply to you, you keep every right those laws give you, and you may bring proceedings in your local courts.
